I am pleased to offer you the part-time position of {{Position}} within Essex Property Trust, Inc. You will be reporting to me. Your specific job responsibilities will be reviewed with you within the first 30 days of your employment and may be revised over time as Essex deems appropriate. {{OvertimeStatement}}

This letter sets forth the principal terms and benefits of your employment with the Company.

  1. You will be paid {{BaseSalary}}, paid on a bi-weekly basis.
    You will be eligible for an annual bonus potential of up to $$$$$ or % of your annual salary which will be pro-rated during your first year of employment. You must be an employee of the Company upon the date the bonus is paid to be eligible to earn and receive this incentive compensation.

  2. While the property is in lease up you will be eligible for additional incentive compensation, as defined under the approved Lease Up Incentive Plan. Once the property’s occupancy stabilizes, you will be eligible for commissions defined within the current Commission Contract in place at that time.

  3. Your starting date will be {{StartDate}}, provided you successfully complete and pass the background process.

  4. You will begin accruing Paid Time Off (PTO) on your first day of employment at a rate of 14 days annually. (which shall accrue on a bi-weekly basis and is pro-rated based upon your weekly hours)

  5. You are eligible to participate in the 401(k) Plan following completion of 30 days of employment if you meet the 1,000 hours of work per year requirement. You will not be eligible for other benefits available pursuant to Company policy based upon your current work schedule.
Your employment will be subject to the Company’s policies and procedures. To the extent that such policies and procedures conflict with the terms indicated above, the terms in this letter shall prevail. All offers of employment are contingent upon the satisfactory completion of a background check, which will include a drug screen (Substance Abuse Panel 5), and your signing of the Company’s Arbitration Agreement. It is also conditioned upon your providing verification of your eligibility for employment in the United States, which meets the requirements of the U.S. Department of Justice. You will be an at-will employee of the Company, which means the employment relationship is voluntarily entered into by mutual consent of the employee and employer, is not for a specified period of time and can be terminated by either the employee or the Company for any reason or at any time, with or without cause. The at-will nature of the employment relationship may not be altered or modified by the conduct of the parties or by implication; it may be changed only by a written agreement signed by you and the President of the Company.
